CATCHY PAGES TERMS OF SERVICE (“AGREEMENT“)

Please read these Terms of Service (“Agreement”, “Terms of Service”) carefully before using https://catchypages.com.au (“the Site”) operated by Catchy Pages (“us”, “we”, or “our”). This Agreement sets forth the legally binding terms and conditions for your use of the Site at https://catchypages.com.au.

By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms of Service. Capitalised terms are defined in this Agreement.

Intellectual Property

The Site and its original content, features and functionality are owned by Catchy Pages and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

Termination

We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Catchy Pages reserves the right to suspend or terminate an account without prior warning if the following conditions have been met:

• The customer account is compromised,
• The customer account is abusing the server resource limits,
• The customer account is sending unsolicited bulk emails,

Activities which are explicitly forbidden by Catchy Pages, but not limited to:

• Online Game Servers
• Internet Relay Chat
• Proxy Servers
• Sites infringing on Copyright content, such as Illegal Warez sites
• Online Gambling
• Sites with illegal pornagraphic content
• Voice or Video on Demand services

Please Note: Catchy Pages is NOT liable for any damages or expenses incurred by suspending or terminating account(s).

Links To Other Sites

Our Site may contain links to third-party sites that are not owned or controlled by Catchy Pages.

Catchy Pages has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party sites or services. We strongly advise you to read the terms and conditions and privacy policy of any third-party site that you visit.

Limited License

Catchy Pages grants you a non-exclusive, non-transferable, limited license to use the Site in accordance with this Agreement.

Limitation Of Liability

In no event shall Catchy Pages, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for damages, direct or consequential, resulting from your use of the Site, and you agree to defend, indemnify and hold us harmless from any claims, losses, liability costs and expenses, including but not limited to attorney’s fees, arrising from your violation of any third-party’s rights.

Warranty Disclaimer

Your use of the Site is at your sole risk. The Site is provided on an “as is” and “as available” basis. The Site is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Catchy Pages, its subsidiaries, affiliates, and its licensors do not warrant that a) the Site will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Site is free of viruses or other harmful components; or d) the results of using the Site will meet your requirements.

Governing Law

This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of New South Wales, Australia, without giving effect to any principles of conflicts of law.

Changes To This Agreement

We reserve the right, at our sole discretion, to modify or replace these Terms of Service by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms of Service.

Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.

Payment Terms

Catchy Pages accepts all major credit cards. Credit Card & Direct Debit processing is completed via Ezidebit (Global Payments Inc), eWay (Web Active Corporation Pty Ltd) and PayPal Australia Pty Limited.

Initial Fees:

Payment of the setup fee and first period’s charges are required for Catchy Pages to activate your service. Setup fees are non-refundable. Fees for domain name setup, renewal, or transfer are non-refundable.

Payment by chq or direct deposit will only be allowed for payment periods 12 months or above. Service for chq and direct deposit paying customers will only be activated after the bank process payment clears.

Cancellation Policy

If for any reasons you to wish to cancel any services, Catchy Pages requires a twenty (20) day formal cancellation notice PRIOR to the renewal billing date for discontinuance or downgrades of services. Please be aware that you MUST follow Catchy Pages formal cancellation process in the proper timely fashion to give an effective notice of non-renewal cancellation.

Formal cancellation can ONLY be submitted from your Client Area located at: https://www.catchypages.com.au/clients/clientarea.php.

Failure to follow Catchy Pages formal cancellation process with the requisite Twenty (20) days effective notice will result in the account being re-billed as per the current billing cycle and no refunds can be issued.

The customer is responsible for all money owed on the account from the time it is established to the time that cancellation has been confirmed by Catchy Pages.

Transferring your domain name(s) or service(s) away from Catchy Pages does not mean your account is automatically cancelled. You must notify Catchy Pages to cancel your account, using the method listed above.

Refund Policy

All services are non-refundable. This includes, but is not limited to: setup fees, one time fees, renewal and service fees (1, 3, 6, 12 or 24 months), upgrade fees, additional service fees, administrative fees, and late fees. Customers seeking to resolve billing errors are instructed to open an billing ticket inside the Customer portal located at: https://www.catchypages.com.au/clients/clientarea.php
